House Republicans want lawmakers back to Capitol Hill after DOJ requested Devon Archer, to surrender to prison during the legislative recess.

The DOJ’s request came ahead of Archer’s scheduled testimony to the committee on the Biden family, Hunter’s business dealings, and the alleged involvement of President Biden in securing these deals.

Reps. Matt Gaetz, Mike Johnson, Chip Roy, Harriet Hageman, and Dan Bishop urged an emergency hearing in Washington, D.C., to address potential DOJ interference in the committee’s investigation into the Bidens. Gaetz accused the DOJ of obstructing a congressional investigation and threatened to call Attorney General Merrick Garland to testify if Archer does not appear for his testimony.

Archer, convicted in 2018 for conspiracy to defraud a Native American tribe, received a letter from the U.S. Attorney’s Office for the Southern District of New York requesting his surrender to prison to begin his one-year sentence. However, the letter did not specifically demand Archer go to prison before his testimony but instead set a date to begin his jail term.

The House Oversight Committee’s hearing with Archer is expected to proceed on Monday at 9 a.m. Archer’s attorney confirmed that he will appear for his scheduled testimony and denied that the DOJ’s request was intended to prevent his meeting with House members.

The court is not expected to decide on Archer’s surrender before his meeting with the House Oversight Committee. The U.S. Attorney’s Office clarified that the DOJ did not request Archer’s surrender before his congressional testimony.
