Despite pleading guilty to three counts of use of abusive language, Nicholas Nelson has gotten off the hook.
The 31-year-old Jerry Corbyn`s supporter targetted Labour MPs with “vulgar, obscene and threatening” abuse between July and September 2018. His charges related to phone calls and emails to Dame Margaret Hodge, MP for Barking, east London, Dame Louise Ellman and Lord (John) Mann, who were also both Labour MPs at the time.
Nelson`s offence against Dame Margret “religiously aggravated” her. Prosecutor Jason Seetal highlighted an 18 July 2018 phone call to her office.
“Margaret should f*** off, you f***ing racist Zionist c***. You need to get out of the party and I hope you die, you Tory c***,” Nelson said.
In a victim impact statement, Dame Margaret said: “I considered the emails to be threatening and was left feeling nervous and unsure about my personal safety.
“For the first time, I now feel under threat because of my Jewish identity.”
In the same year, Nelson harassed Jewish then Labour MPs Luciana Berger and Ruth Smeeth in March and April. He was sentenced to 5-month imprisonment, suspended for a year, in December 2018.
On 3 September 2018, Nelson sent a very offensive phone message to Lord Mann, which said: “Kill yourself. When are you going to have a stroke?”
On Wednesday, Deputy Chief Magistrate Tan Ikram at Westminster Magistrates’ Court gave him a 30 weeks-prison sentence, suspended for 18 months.
“I’m of the view that these offences are so serious that they cross the custody threshold,” he said.
“People should feel able to come forward and serve as MPs without fear of violence and threat. Certain communities have felt particularly under threat. And these courts will send a clear message to those who threaten members of those communities, who attack them because of their faith.”
The judge said he would have jailed Nelson for all the offences in 2018, but he considered suspending the sentences, though this “doesn’t take away the seriousness of the offences”.
Nelson expressed regret of his conduct and offered a full apology to all his victims.
